These Terms of Use ("Terms") apply when you visit evolvm.com or send an inquiry to Evolvm ("Evolvm", "we", "us" or "our"). By using the website, you agree to these Terms. If you do not agree, please do not use the website.

1. Using this website

You may use this website to learn about Evolvm and contact us for legitimate personal or business purposes. You may not misuse the site, interfere with its operation, attempt unauthorized access, introduce malicious code, scrape it in a way that disrupts service, or use its content unlawfully.

The website and its original text, design, branding and code are owned by or licensed to Evolvm. You may not copy, republish or commercially exploit them without written permission, except as allowed by law.

2. Inquiries are not service agreements

Submitting a form or discussing a project does not create a client relationship, reserve development capacity or require either side to proceed. Software work begins only after both sides accept a written proposal, statement of work, subscription agreement or similar project document.

That project agreement will control the scope, deliverables, timeline, revisions, acceptance, fees, payment schedule, cancellation rights, support and any other project-specific terms. If it conflicts with these website Terms, the signed project agreement controls for that project.

3. Pricing and estimates

Website prices are starting or founding prices for the described scope and may change. A listed price is not a binding quote for work outside that scope. Hosting, domains, paid tools, API usage, app-store charges, taxes and other third-party costs are excluded unless a written proposal says otherwise.

Timelines are good-faith estimates based on a clear scope and timely client feedback. Delays in access, materials, decisions, third-party services or scope changes may move delivery dates.

4. Client responsibilities

Clients are responsible for giving timely feedback, accurate requirements, necessary access and materials they have the right to use. Clients are also responsible for reviewing deliverables, maintaining credentials securely, backing up their data and ensuring their business and requested use comply with applicable laws.

5. Ownership and reusable tools

Unless a project agreement says otherwise, after full payment the client owns the bespoke final deliverables created specifically for that project. Evolvm keeps ownership of pre-existing materials, general know-how, methods, templates, reusable components and development tools. Open-source and third-party materials remain subject to their own licenses.

We will not publicly identify a client or publish confidential project details as a case study without permission. Any separate confidentiality agreement will also apply.

6. Third-party services and links

Projects and this website may rely on third-party platforms such as hosting, email, payment, automation, cloud or API providers. Their availability, security, pricing and terms are outside our control. Links to third-party websites are provided for convenience and do not imply responsibility for their content.

7. Disclaimers and responsibility

The website is provided on an "as available" basis for general information. We try to keep it accurate and available, but do not promise that it will always be error-free, complete or uninterrupted. To the extent permitted by applicable law, Evolvm is not liable for indirect, incidental or consequential loss arising only from use of this website.

Nothing in these Terms excludes responsibility that cannot legally be excluded. Liability for paid software services will be addressed in the applicable project agreement.

8. Applicable terms and disputes

These Terms operate subject to applicable law. Any service-specific governing law and dispute process will be stated in the written project agreement. Before starting formal proceedings, both sides should first try in good faith to resolve a concern directly.

9. Changes

We may update these Terms as the website and services evolve. The revision date at the top identifies the current version. Continued use after an update means the revised Terms apply from that point forward.
